1. About this Privacy Policy

Successful Swimming respects the privacy of our customers, swimmers, families, staff and other individuals whose personal information we collect.

This Privacy Policy explains what personal information we collect, why we collect it, how we use and protect it, when it may be disclosed to third parties, and how you can access or request correction of information we hold about you.

Successful Swimming aims to manage personal information in accordance with applicable Australian privacy requirements and the principles contained in the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth), where applicable.

2. What Personal Information We Collect

Depending on the services you receive from Successful Swimming, we may collect personal information including:

  • the name of a parent, guardian or other customer;
  • the name of a child or adult swimmer;
  • mobile telephone numbers;
  • email addresses;
  • home or lesson addresses, including the location of a customer's swimming pool;
  • emergency contact details, where appropriate;
  • information provided during customer onboarding or lesson administration;
  • information necessary to organise, provide and manage swimming lessons; and
  • information relating to payments, invoices and accounts.

Where relevant to providing safe and appropriate swimming instruction, we may also collect information voluntarily provided by a customer about a swimmer's abilities, needs, limitations, medical circumstances or other relevant information. Where such information constitutes sensitive information under Australian privacy law, we will handle it in accordance with the applicable legal requirements.

We aim to collect only information that is reasonably necessary for the operation and provision of our services.

3. How We Collect Personal Information

We generally collect personal information directly from you when you:

  • enquire about our services;
  • make a booking;
  • complete an onboarding or registration form;
  • communicate with us by phone, email or other communication channels;
  • provide information to us during or in connection with swimming lessons; or
  • make or arrange payment for our services.

We may also receive information from a parent, guardian or other authorised person where they are arranging lessons or services on behalf of a swimmer.

4. Why We Collect and Use Personal Information

Successful Swimming collects and uses personal information for purposes including:

  • communicating with customers and swimmers;
  • arranging and managing swimming lessons;
  • knowing the location of a customer's swimming pool;
  • providing relevant information to swimming coaches;
  • contacting customers regarding lesson changes, lateness, illness, cancellations or other operational matters;
  • sending invoices and managing payments;
  • completing customer onboarding and administrative requirements;
  • responding to enquiries and providing customer support;
  • maintaining appropriate business records;
  • managing our business operations; and
  • complying with applicable legal and regulatory obligations.

Customer mobile numbers and email addresses are used primarily for communication relating to the customer's lessons, account and relationship with Successful Swimming.

We do not use customer information for unrelated purposes.

5. Information Provided to Swimming Coaches and Staff

Successful Swimming limits the information provided to staff and coaches according to what they reasonably require to perform their role.

For example, a swimming coach may be provided with a customer's name and lesson address where this is necessary to attend and conduct a lesson.

Administrative staff may be provided with relevant customer contact information where they need it to contact a customer or perform an administrative task.

Staff are not provided with unrestricted access to all customer information unless that access is required for their role.

The founders of Successful Swimming retain overall administrative access and oversight of customer information.

6. Payments and Financial Information

Successful Swimming does not personally collect, store or have access to customers' full banking or credit/debit card details.

Invoices and payments are processed through third-party payment and accounting services, including Xero and Stripe.

Where you make a payment through one of these services, your payment information is handled in accordance with the relevant provider's own privacy and security practices.

Successful Swimming may retain information such as invoices, payment status and transaction records that are necessary for business administration, accounting and legal purposes, but does not store customers' full card or banking details.

7. Disclosure to Third Parties

Successful Swimming does not sell customer personal information.

We also do not disclose customer information to unrelated third parties for their own marketing purposes.

Personal information may, however, be provided to service providers where reasonably necessary for Successful Swimming to operate its business or provide its services. This may include providers such as Xero and Stripe for invoicing, accounting and payment processing.

Information may also be disclosed where required or authorised by law, where necessary to protect the safety of an individual, or where otherwise permitted or required under applicable privacy laws.

Where practical, Successful Swimming seeks to ensure that access to customer information is limited to what is reasonably necessary for the relevant purpose.

8. Overseas Disclosure and Third-Party Services

Some third-party technology, accounting, payment, communication or storage providers used by Successful Swimming may process or store information outside Australia.

Successful Swimming does not intentionally sell or otherwise commercially trade customer personal information.

Where an overseas disclosure of personal information occurs, Successful Swimming will take reasonable steps to ensure that applicable privacy obligations are considered and addressed.

9. How We Protect Personal Information

Successful Swimming takes reasonable steps to protect personal information from misuse, loss, unauthorised access, modification or disclosure.

Customer information is stored using password-protected private hardware, email accounts and business systems.

Our laptops and mobile phones are protected by security measures, including passwords and device security.

Access to customer information is restricted according to role and operational need.

Founders of Successful Swimming retain overall access and oversight of customer information. Staff members are only provided with the information reasonably required to perform their duties.

We regularly review our information-handling practices and may update our security measures as technology and business requirements change.

10. How Long We Keep Personal Information

Successful Swimming retains personal information only for as long as it is reasonably required for the purposes for which it was collected, for legitimate business purposes, or where retention is required or permitted by law.

When personal information is no longer required and there is no legal or other legitimate reason to retain it, we will take reasonable steps to securely destroy or de-identify it.

Certain records, including financial and business records, may need to be retained for a period required by Australian law.

11. Accessing and Correcting Your Information

You may contact Successful Swimming to request access to personal information we hold about you or to ask us to correct information that is inaccurate, out of date, incomplete or misleading.

Requests can be made by contacting:

Email: bookings@successfulswimming.com.au
Phone: 0428 843 949

We will respond to requests within a reasonable period and will generally provide access or make corrections where required by applicable privacy law.

In some circumstances, we may need to refuse access or correction where permitted or required by law. If this occurs, we will explain the reason where we are legally permitted to do so.

12. Requests to Delete Personal Information

You may ask Successful Swimming to delete personal information we hold about you.

Where the information is no longer required for a lawful or legitimate purpose, we will take reasonable steps to securely delete or de-identify it.

However, we may need to retain certain information where required by law, for accounting or business record-keeping purposes, to establish or defend legal claims, or where another lawful basis for retention applies.

13. Marketing and Communications

Successful Swimming does not operate an automated promotional email subscription requiring customers to opt out.

We may contact customers using their provided email address or mobile number where reasonably necessary to administer lessons, bookings, invoices, customer accounts or other services requested by the customer.

This may include communications about lesson changes, lateness, illness, cancellations or other information relevant to the customer's relationship with Successful Swimming.

If Successful Swimming introduces promotional or direct marketing communications in the future, we will provide appropriate mechanisms for customers to opt out where required by law.

14. Website and Online Information

When you use our website or interact with Successful Swimming online, certain technical information may be collected automatically by website, hosting, analytics, security or other technology providers.

Depending on the technology used on our website, this may include information such as IP address, browser type, device information and website usage information.

16. Changes to This Privacy Policy

Successful Swimming may update this Privacy Policy from time to time to reflect changes to our business, technology, privacy practices or applicable legal requirements.

The current version of this Privacy Policy will be made available on our website, together with the date it was last updated.

Where a change is material, Successful Swimming will take reasonable steps to notify affected customers where appropriate.
